Article 8 of the European Convention on Human Rights states that every individual has the right to his or her “private and family life, his home and his correspondence,” and to not have these things interfered with.
Privacy Directive
Directive 95/46/EC on the Protection of Personal Data provides a cohesive, all-encompassing piece of legislation, incorporating all the principles of its predecessor, the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, and those in article 8 of the ECHR, while also allowing for the free flow of data in the EU.
